J7 Solutions Transportation – Terms and Conditions of Service

By using J7 Solutions Transportation’s vehicle transportation broker services, you (the “Customer”) and the person or entity you represent accept all terms and conditions stated herein (“TERMS”). In the event of a conflict between these TERMS and any other document (including a motor carrier bill of lading, tariff, or service guide), these TERMS shall control. J7 Solutions Transportation reserves the sole right to modify these TERMS.

IMPORTANT DISPUTE RESOLUTION NOTICE

THESE TERMS CONTAIN PROVISIONS GOVERNING HOW CLAIMS BETWEEN CUSTOMER AND J7 SOLUTIONS TRANSPORTATION MAY BE RESOLVED. THESE PROVISIONS GENERALLY REQUIRE CUSTOMER TO SUBMIT CLAIMS TO BINDING ARBITRATION ON AN INDIVIDUAL BASIS, NOT AS A CLASS ACTION. SEE SECTION 12 FOR DETAILS.


1. Definitions

a. Additional Services – Upgrades (e.g., covered transport, guaranteed pickup, extra belongings).
b. Bill of Lading – Carrier-issued document detailing shipment condition, origin, destination, etc.
c. Carrier – Licensed motor carrier (per 49 U.S.C. §13102(14)) or ocean carrier (per 46 U.S.C. §30701).
d. Carrier Form – Inspection report, bill of lading, or similar document.
e. C.O.D. – Collect on delivery (payment due at delivery).
f. Customer – Entity or individual ordering transportation services.
g. Customer’s Agent – Person (18+) authorized to act on Customer’s behalf.
h. Destination – Drop-off location designated by Customer.
i. Inoperable – Vehicle cannot be driven (e.g., engine/transmission failure, missing parts).
j. J7 Solutions Transportation (“we,” “us”) – A transportation broker (DOT/FMCSA licensed), not a carrier.
k. Order – Customer’s request for transportation services.
l. Order Confirmation – Written confirmation of Order details (vehicle, dates, pricing).
m. Point of Origin – Pickup location designated by Customer.
n. Shipment – Customer’s vehicle being transported.


2. Services

a. J7 Solutions Transportation arranges transportation via third-party Carriers. We reserve the right to refuse/cancel Orders.
b. Our services are complete when a Carrier accepts the Order.
c. We are not a motor carrier and do not take possession of shipments.
d. Delays may occur due to weather, mechanical issues, etc. No guaranteed delivery times.


3. Customer Responsibilities

a. Accurate Information – Ensure all Order details (vehicle, locations) are correct.
b. Shipment Condition – Disclose modifications (e.g., lifted chassis, oversized tires); additional fees may apply.
c. Preparation – Secure loose parts, disable alarms, limit fuel to ¼ tank.
d. Personal Property – Max 100 lbs. in trunk; valuables prohibited. Carrier not liable for personal items.
e. Prohibited Items – No weapons, flammables, narcotics, or illegal goods.


4. Customer Warranties

Customer warrants compliance with all laws (customs, import/export) and provides necessary documentation.


5. Pickup & Delivery

a. Customer or Agent must be present for inspection.
b. Note all damages on the Bill of Lading at pickup/delivery. Signing without exceptions waives claims.


6. Carrier Responsibilities

a. Carrier delivers as close to Customer’s door as safely possible.
b. Carrier may issue a Bill of Lading (separate contract between Carrier and Customer).


7. Fees & Payment

a. Payment due upon Carrier acceptance. No offsets for claims.
b. C.O.D. payments to Carrier: cash, cashier’s check, or money order only.
c. Late payments incur 1.5% monthly interest + collection costs.


8. Cancellation & Refunds

a. No fee if canceled before Carrier acceptance. After acceptance: $249 minimum fee + Carrier charges.
b. Refunds only for unfulfilled services.
c. Cancellations must be emailed to info@j7solutionstransportation.com.


9. Claims for Loss/Damage

a. J7 Solutions Transportation is not liable—claims must be filed directly with the Carrier.
b. Report claims within 48 hours of delivery.
c. Federal laws (Carmack Amendment, COGSA) govern claims.


10. Indemnification

Customer indemnifies J7 Solutions Transportation against all claims arising from their breach.


11. Limitation of Liability

a. Our maximum liability = fees paid for the Order.
b. No warranties (express or implied).
c. No consequential damages (lost profits, etc.).


12. Arbitration

a. Disputes resolved via binding individual arbitration (National Arbitration Mediation).
b. Class action waiver – Claims must be brought individually.
c. Small claims court and injunctive relief exceptions apply.


13. Governing Law

These TERMS are governed by Illinois law (or federal law where applicable).


14. General Terms

a. Independent contractor relationship.
b. No assignment without written consent.
c. Severability – If any clause is invalid, the rest remain enforceable.

15. SMS Terms and Conditions

If you have provided your phone number to us, you consent to receive informational and transactional SMS messages from J7 Solutions Transportation. Message and data rates may apply. Your consent is not a condition of any purchase. Message frequency will vary depending on your order status and communication needs.
